Fair Dealing

In order to conduct review and criticism of the events posted on this site, I need to be able to reliably refer to the events. Linking to articles on other sites (for example newspaper web sites) as the source of the research for review and criticism often fails to be reliable because those sites are under a third party’s control and over time may remove their content, move it to a different URL, or otherwise prevent reliable (accurate and persistent) references.

I link to various publicly accessible sites and articles for the purpose of criticism and review. If an article or entire site becomes unavailable (goes offline for example) for the sake of criticism and review, I will include PDF copies in my posts so that people may review and criticise them.

For those reasons I think that I must act in accord with the fair dealing exceptions in the Canadian Copyright Act. I will do my utmost to provide all appropriate citation information, not only because it is right and required in fair dealing but because I think it improves the accuracy of this web site.

Here is an excerpt from the Copyright Act (linked above) that explains fair dealing.

Research or private study
29. Fair dealing for the purpose of research or private study does not infringe copyright.
R.S., 1985, c. C-42, s. 29; R.S., 1985, c. 10 (4th Supp.), s. 7; 1994, c. 47, s. 61; 1997, c. 24, s. 18.

Criticism or review
29.1 Fair dealing for the purpose of criticism or review does not infringe copyright if the following are mentioned:
(a) the source; and
(b) if given in the source, the name of the

(i) author, in the case of a work,
(ii) performer, in the case of a performer’s performance,
(iii) maker, in the case of a sound recording, or
(iv) broadcaster, in the case of a communication signal.

News reporting
29.2 Fair dealing for the purpose of news reporting does not infringe copyright if the following are mentioned:
(a) the source; and
(b) if given in the source, the name of the

(i) author, in the case of a work,
(ii) performer, in the case of a performer’s performance,
(iii) maker, in the case of a sound recording, or
(iv) broadcaster, in the case of a communication signal”
